Terms and Conditions* This legal document refers to the agreement between the Client (specified above) and Yves Martineau, a Regulated Canadian Immigration Consultant, member No. R415279 of the College of Immigration and Citizenship Consultants, with a place of business at 7450 rue Saint-Hubert, Montreal, QC, H2R 2N3, Canada, phone number 1-514-360-3190, hereinafter referred to as the "Consultant".
The Client hereby agrees to retain the Consultant to provide revision services of his application and the Consultant does hereby agree to provide such services, the whole subject to the following terms and conditions:
1. The Client hereby agrees to engage the Consultant in order to review his application.
2. The Client will share with the Consultant the scanned application in full just as it will be presented to the Canadian government, based on the corresponding instructions in force published by Immigration, Refugees and Citizenship Canada or the provincial authorities, as applicable.
3. The Consultant will review the application within 3 business days and prepare a written report about all comments and suggestions that may improve the application. The 3 business days are to be calculated from the moment all of the following are received by the Consultant: the payment, the approval of the terms of the present agreement and all of the documents to be reviewed.
4. The revision service is no guarantee of approval as the final decision is at the discretion of the Canadian government.
5. As part of the service, the Consultant will ensure that the government forms are complete and properly signed, without verifying the accuracy of the declared information.
6. The Client shall provide truthful information, understanding that it is his duty to ensure accuracy and that the Consultant has no responsibility regarding the information provided by the Client.
7. The Consultant will keep all Client's information highly confidential and not going to share it with any third party, without prior consent (except as demanded by law), for the entire validity of the agreement and after its termination. The employees and consultants of Martineau & Mindicanu Inc. are not considered to be a third party for the purpose of this agreement.
8. The Consultant will work on Client's file together with the employees of Martineau & Mindicanu Inc. and with Mihaela Mindicanu, a Regulated Canadian Immigration Consultant, member no. R415695. The final report will be sent to the Client by Mihaela Mindicanu and the Client will be in communication with her for any questions regarding the comments made by the consultants.
9. The file will be reviewed only once, in its final version, as the client plans to present it to the government. A second revision of the documents after the Client made eventual changes following the advice received from the consultants is not included.
10. In the eventuality of questions about how to prepare the file, before the revision service is performed, the Client can schedule a personalized consultation.
11. Consultant fees are only and solely for the counseling services and do not include fees charged by the government, nor third parties.
12. The present agreement is not a representation agreement and is limited to the revision of the documents provided by the Client.
13. The Consultant will not be responsible for the performance of any duties that are not mentioned in the present agreement.
14. The Client agrees to pay the Consultant the sum of $1,200 (one thousand two hundred) Canadian dollars upon the signature of the present agreement. If the Client is residing in Canada when the service is rendered, taxes apply according to the Canadian law.
15. No reimbursement is possible once the service is rendered. Should the Client request a reimbursement before the service is rendered, a $350 administrative fee will apply.
16. As the context may require, the singular shall include the plural and vice versa; words importing the masculine shall include the feminine gender and vice versa;
17. The Client is advised that the Consultant is a member in good standing of the College of Immigration and Citizenship Consultants, and as such, is bound by its By-laws, Code of Professional Conduct (https://college-ic.ca/protecting-the-public/code-of-professional-conduct?l=en-US), and associated Regulations. In the event of a dispute related to the Code of Professional Conduct, the Client and Consultant are to make every effort to resolve the matter between the two parties. In the event a resolution cannot be reached, the Client is to present the complaint in writing to the Consultant and allow the Consultant 21 calendar days to respond to the Client. In the event the dispute is still unresolved, the Client may follow the complaint and discipline procedure outlined by the College on their website (https://college-ic.ca/protecting-the-public/complaints-process). In the event the Client is unable to contact the Consultant and has reason to believe the Consultant may be dead, incapacitated or otherwise unable to fulfill his duties, the Client should contact the College.
18. The parties acknowledge that they have requested that the foregoing be drawn up in the English language; Les parties reconnaissent qu'elles ont exigé que ce qui précède soit rédigé en la langue anglaise.
19. These terms and conditions shall be governed exclusively by the laws in effect in the Province of Quebec, Canada and any dispute in respect to the application or interpretation of the present agreement, or in any other way emerging from or related to the present agreement, shall be heard exclusively by an authority of the Province of Quebec, Canada.
20. The Client and the Consultant agree that for the purpose of this agreement, upon electronic acceptance of the terms by the Client, the present agreement is considered signed by both parties on the date the terms are accepted by the Client.
